In consideration of the acceptance of this entry in the East St. Paul Canada Day Super Run I, for myself, my heirs, executors, administrators and assigns, waive any claims to which I may become entitled for injury or damage and release all organizers, sponsors, representatives, their agents and employees and any other person or organization assisting in this event, including the Manitoba Runners’ Association, the race director Windburn Multi-Sport Academy, the R.M of East St. Paul, the Province of Manitoba, and their employees and agents and other participants and volunteers in the East St. Paul Canada Day Super Run, from any claims for damages or injury suffered by me as a result of my participation in this event. I further state that I am in proper physical condition to participate in the event and I am aware that road running is a potentially dangerous activity and am aware that participation could, in some circumstances, result in physical injury. I give my permission for the free use of my name and picture in broadcast, telecast or written account or this event.

I understand that the Kildonan Park Family Duathlon staff will make every reasonable effort, in the circumstances, to reach my emergency contact, as provided, to address my medical status in the event an emergency arises. In the event that my emergency contact cannot be reached as and when necessary, I hereby give my permission to the licensed physician, dentist, athletic therapist, nurse or other medical professional whose services might be required to provide me with medical care and/or treatment, as deemed necessary.

I have voluntarily elected and intend to participate in the Kildonan Park Family Duathlon, and related programs, events and activities (collectively “the Activity”). I acknowledge that my participation in the Activity poses known and unknown dangers and risks, including risk of serious injury or death. Without in any way limiting the generality of the foregoing, the risks and hazards of the Activity include, but are not limited to, injuries as a result of:
Entering the water by either diving, running or jumping;
Spending extended times in pools or lakes including bacterial infections and rashes;
Physical contact with other participants while swimming including crowding, pushing, kicking and punching;
Water conditions such as currents, waves, water temperate and water clarity;
Physical contact with pool walls or lake rocks and bottoms;
Physical contact with other participants while cycling and running;
Road conditions, terrains and vehicular traffic while cycling and running;
From one’s failure to stay within the designated course area while cycling and running;
Falling while cycling or running;
Strenuous cardiovascular workouts, and/or exerting and stretching various muscle groups;
Psychological factors such as anxiety;
Changing weather conditions;
Burns or lacerations from disc brakes;
Dehydration and/or fatigue; and
Negligence of other participants.
I have satisfied myself that I am physically, emotionally and mentally able to participate in the Activity and that my attire and my equipment, if any, is safe and suitable for use in the Activity. I accept full responsibility for understanding and following the rules and safe practices associated with participation in the Activity and I accept that full responsibility for my personal safety rests with me at all times. I will immediately remove myself from participation in the Activity, and notify the nearest official, if at any time I sense or observe any unusual hazard or unsafe condition or if there is any change in my physical, mental or emotional fitness for continued participation in the Activity.
ACCEPTANCE OF TERMS AND CONDITIONS

I will comply with all the rules and regulations of Triathlon Canada, the International Triathlon Union, subject to the exclusion below with respect to disc brakes, and the instructions of the event organizers and officials.
I am aware of Triathlon Manitoba’s bylaws and policies (which can be found at www.triathlon.mb.ca) and agree to be bound by them.
I have sole responsibility for my personal possessions and athletic equipment during the Activity.
I grant full permission for Kildonan Park Family Duathlon or Triathlon Manitoba to use my personal likeness, including as contained in any photographs, as part of the event website photo gallery.
In the event of a race cancellation due to a storm or other “force majeure” my entry fee will be non-refundable.
With my participation in the event and/or Activity, I may be subject to unannounced drug testing as provided for by Triathlon Canada’s agreement with the Canadian Centre for Ethics in Sport.
SPECIAL NOTE – NON COMPLIANCE WITH ITU RULE REGARDING DISC BRAKES
Recently, the International Triathlon Union implemented a rule prohibiting disc brakes, except for PT1 and cross triathlon athletes. However, Triathlon Manitoba has allowed Kildonan Park Family Duathlon to utilize disc bakes in this particular competition and Activity. By signing / initialing below, I acknowledge that the Activity will NOT adhere to or comply with the rules of the International Triathlon Union with respect to disc brakes, and I fully accept all associated risks and liabilities relating to the use of disc brakes in the Activity. My waiver and release from liability, set out below, applies in full force and effect notwithstanding the non-compliance with the International Triathlon Union rule regarding disc brakes.

I further acknowledge and understand that insurance coverage for this event does not provide me with personal accident insurance coverage and that I am responsible to obtain my own personal accident insurance coverage should I wish to be eligible for accident benefits that are in excess of those currently covered through my provincial or private health insurance plan(s).

My waiver and release from liability, set out below, applies in full force and effect notwithstanding the non-compliance with the International Triathlon Union rule regarding disc brakes.
WAIVER AND RELEASE FROM LIABILITY
In consideration of my participation in the Activity, I, for myself, my heirs, executors, administrators and next of kin, including any accompanying minors, HEREBY RELEASE, WAIVE AND FOREVER DISCHARGE Triathlon Manitoba, St. Malo Triathlon, Tribalistic Triathlon Club, and all of their directors, officers, members, employees, coaches, officials, volunteers, race directors/organizers, agents, sponsors, funding partners, and owners/operators of the facility/venue, FROM ANY AND ALL CLAIMS, DAMAGES AND LIABILITY of any kind whatsoever that I may have against them, their representatives, successors and assigns, in respect to death, illness, injury, or loss or damage to my person or property, HOWEVER CAUSED, that I may sustain as a result of my participation in the Activity, AND NOTWITHSTANDING that the loss, claim, damage or liability may have been contributed to or caused by the negligence or breach of duty of any one or more of the above named.
I further acknowledge and understand that insurance coverage for this event does not provide me with personal accident insurance coverage and that I am responsible to obtain my own personal accident insurance coverage should I wish to be eligible for accident benefits that are in excess of those currently covered through my provincial or private health insurance plan(s).
BY SUBMITTING THIS ENTRY, I ACKNOWLEDGE HAVING READ, UNDERSTOOD AND AGREED to the above AWARENESS AND ACKNOWLEDGMENT OF RISKS, TERMS AND CONDITIONS and WAIVER AND RELEASE FROM LIABILITY AND HAVE EXECUTED THIS AGREEMENT VOLUNTARILY.
I have read this document thoroughly and I understand that, by signing it, I will WAIVE AND GIVE UP IMPORTANT LEGAL RIGHTS, including the right to sue. I have been afforded a full and unconstrained opportunity to withdraw from the Activity, should I not wish to assume all of the dangers and risks associated with it, but I have freely and voluntarily elected to assume all of these dangers and risks, to give up important legal rights as set out in this document, and to participate in the Activity.
